Help with Labor Lien

I have a company that owes me $ how do I put a lien on it? They owe over 20k going on 60 days.Any help would be good. Thanks RIPPY. Oh and if they file the big B am I sol?

Local courthouse is where you will go to put the lien on the property. As for the BK, more than likely you will SOL. But not in all cases, just depends.

Is this like the last resort option? They tell me they are waiting on a loan to close. They paid me half up front and havent paid the other.Help

I know we got a lawyer to help with big loss here in my area. I am fairly sure the lien stays with the property, so if another contractor comes in, I believe that company assumes the debt. If it is a residential home, the lien follows the deed. I think. May advice, call a lawyer. That's a lot of money to lose, and you need your ducks in a row, if you hope to get any kind of return.

If they own the property but are waiting on a loan to close, if I were you, I'd lien the property. They can't close the loan until your lien is released.

Thanks to all.. This may sound crazy but I dont want to make them mad because they have about 75k more in work for me to do.That being said I know If they dont pay There is no use doing work for them. Will the lien burn a bridge?

are you a sub?, or the contractor?, I dont think you can file a lien as a sub. or this is what Ive been told. anyway goodluck, I know how it is to have to track money down!!

My job is to track down money, from those that don't care to pay LOL.

Justice Court, file a claim.

Bankruptcy, depends what chapter, but you may get the short end of the stick.

My Suggestions, get on it and get on it quick.

If you did some sort of work on a property, you can file a mechanics lein.
It's better to have it and not need it, than need it and not have it.

Send them a cert. letter demanding payment with 5 working days (or a personal conversation). If not you will be forced to file a lien. It's not a big deal. When and if payment is received, you remove the lien. Courthouse. Property can NOT be sold with an outstanding lien with one exception and that is they can double escrow the lien amount, and continue with closing.

I may be a little niave but I would go talk with them first, tell them of your intentions and see what type of response you get. I work for a large company and the accounting side of it sucks terribly. Matter of fact it is nothing for them to hold payments 60days before releasing them. It makes me mad because I have small guys that do work for me and that are living out of their business that can't get paid in a timely matter. But they don't hesitate to hit you up when you owe them. If they are truthful and you step on a toe could you lose that business?
