Let me go ahead and type the defendants story. This is what the pit owners will say:

Well the dog probably thought that your son was going to hurt the owner. IT is a defense mechanism. Or, They have probably beat this dog and bred it it to him because the one I have is 10 yrs old and would not harm a fly. We treat him like a baby. BLAH BLAH FREAKIN BLAH

In my experience with handling cases on behalf of people bitten by pit bulls, many homeowners insurance companies (especially Allstate) will deny coverage and refuse to pay medicals and other damages claiming that either the policy has a pit bull exclusion or that the dog owner failed to list the pit in the application for the policy. When the injured person asks the insurance adjuster for a copy of the ins policy to confirm the exclusion or the amount of available coverage ($), the insurance company will tell them that it is against their corporate policy to provide a copy of the actual ins policy documents to the injured party. The only way to force the ins. co. to turn the insurance policy over is to hire a lawyer and file law suit so the lawyer can subpoena the insurance documents.

The dog should have been put down after the first incident. I was also attacked by a neighbors dog (not a pit) when I was 13. After the attack we also found out that it was the not the dogs first attack. I have no tolerance for any dog that will bite someone outside of protecting his/her owner from bodily harm. I am glad it was not worse on your son an he is ok. My attack was over 22 years ago and I can still vividly see that dog going after my face and me blocking him with my upper arm. He bit me three more times before he stopped, I don't remember those bites. Only thing that kept that 80 lb dog from killing me was I was able to hold on to a fence and keep him from getting me down on the ground.

If you have a dog that bites someone unprovoked he will do it again and most likely it will be worse next time.

Thats terrible Mike I wish him the best in a speedy recovery. I just plain dont like a dang pit. In my line of work we reapond to medical emergencies at peoples residence. One of the first questions I ask upon the door being answered (due to a large portion of our calls being Obama supporters) is due you own a pit bull. If the occupant says yes, I do not nor do I allow my partner to enter the residence until the dog has been secured in another room. I have heard the story god knows how many times in my young carreer, " oh its ok buttercup wouldn't hurt a fly he is 10 years old and never even growled at anyone". But I am a stranger in the home and will be approaching an "owner" , so I cover my ass. Seen a fireman trying to start CPR on a woman one day, out of a back bed room, a pit comes charging into the den and latches onto this firemans thigh. Luckyly he had his turnout bottoms on and they took the brunt of the attack. My partener was quick witted and a vet in EMS and took a 25 LBS O2 tank to that things head. He was euphenized and the owner was charged with assault or something like that. Long story to say I wish they would become extinct.

I have a rescue Pit who was abused and is emotionally damaged. I love Stella to death, but if she ever did something like that I would have her put down.

About 2 months ago my girlfriend was messing around and slapped me on the back and Stella got her lazy booty off the couch and started growling. I beat the piss out of her because I'm afraid of what she may be capable of.

I'll give that generic phrase that "she wouldn't hurt a fly", but that's only because she'd be afraid of it.

I am very aware that Pits can be dangerous and have made an effort to nip any aggressive behavior in the bud.

I have 2 boxers and my insurance I have to pay more for bc of them. They asked when I was there getting it. This covers if they attack or accidentally hurt someone it covers it completely. Alot of insurances will also not cover you if you have any of the 4-5 agrresive breads they all them.

Saying a prayer for your son man. Hopefully everything works out and he gets better and heals good.

Most states allow a dog one bite...I would let the animal control folks know what's going on with this dog. I myself would put down any dog that could cause that kind of damage to a person...prayers sent for your boy

Ms is no longer a one bite state. Now, under the Mongeon case, if a dog owner observes or someone tells the owner that the dog even so much as a barked or growled at someone, the dog's owner is on notice of the dog's propensity to injure humans and may be held liable for injuries caused by the dog even if the dog has never bitten before.

Those dogs are nothing but a loaded gun, imo. Glad your son is ok! It looks like it could have been much worse.
