Does it show on the receipt you paid for a 2010? I think I would contact Mercury. Wont cost you anything, and they may solve it for you without it costing for a lawyer.

That's the way our dealings went with them.

I would think that if it says 2010 that would be fruad and would need to be reported to horn lake police dept

Not coming to Chuck's defense because I would have told you the engine had been made in 2008. Starting about 2006 Mercury no longer went by year models. A dealer could have a new non-current engine in stock and the day it was sold it becomes that current year model.

That seems malicious itself. What if the 2010 has several features on it that the 2008 didn't and that is one of the main selling points to that particular customer? Saying a it's a 2010 doesn't morph the motor produced in 2008 into having the "2010 model" features. Not attacking you miket for shedding some light on that, if it's true, Mercury has f'd up, misleading way of doing business....but hey, they're black  . One more reason to buy a Yammy.

He has already talked with the dealership, to no avail. Get a lawyer.

I don't know exactly how they work it because I don't sell engines but it applies to a series of years when no changes have been made to a specific model. If a 25hp stays the same from 2008-2010 and in 2011 the make significant changes, a 2010 can't be considered a 2011.

Dont you have a period of time to take back a product in MS, Like a "i am a DA with buyers remorse, That shouldnt have bought this 2011 caddie" or something.

Maybe you can use that and tell em to screw themselves.

The fact is you paid for a 2010 and I would assume that motor was built in '08. Either way, If you went to sell that boat today, I wouldn't think you would be able to get anything close to what you paid for it. Obviously the boat and motor automatically depreciate the minute you pull off the lot, but yours just depreciated by 2 years! There's noway anyone would pay you a '10 value for a motor that was marked '08. I'm no lawyer, but I would think you have a pretty good case and should easily be able to prove a financial loss. Don't know what you paid for it, but the '08 has an average retail of about $2,300.

I think all Mercury's are the year model of the year you purchased it. It could have been made in 2008 and purchased in 2010 thus making it a 2010 model. I think Merc did aeay with year models a few years ago.
